Ritter to the Defendant’s motion to dismiss?  Actually, I don’t quite know how to punctuate “defendants” in that last sentence.  Should it be defendant’s or defendants’ as if Tarshis is acting on behalf of the NCDA as well as the City of Newburgh, conveniently their newly minted co-defendants?
